Mutuc vs COMELEC
June 26, 2007Subject: Constitutional Law I Professor: Dean Magsalin
The professor started calling names from his list…Ms. Tan, Eileen going upwards. My heart started raising like horses in the wild. Toes turning blue…Fingers started dying…Air became scarce…I need a sickness bag!
Ms. Conde…Ms. Bustamante…Ms. Buenconsejo…
And the Dean uttered the words that showed an eventual doom: "Ms. Bravo, in the case of Mutuc vs COMELEC, what can you say about the matter regarding the supremacy of the Consitution?"
I became dizzy…palms sweaty…knees knocking on heaven's door…and toes going blue…I released the air out from my lungs, pinched my lifeless fingertips and began my very first recitation as a law student. During the entire 5-or-so-minute agony, as I narrated the facts of the case and the issue and the ruling of the court, I could not hear myself talk as I had gone deaf due to sheer panic. Pwede pala 'yun? Akala ko gutom at sobrang "carnal access" lang ang nakakabingi. This is entirely new!
After extracting every bit of information with regard to the unconstitutional regulation of the COMELEC imposing censorship on the respondent's campaign jingle and all those crap about tampering with the Constitution, the good Dean asked me to take my seat. A few seconds after I calmed my wobbling knees, I retrieve my nicotine friend from my bag and stepped out.
*WHEW* Scary shit, man!
Then I thought about Mr. Mutuc…Sir, whoever you are, you will always be in my heart because you are the primal reason why it almost stopped.

im in my first year as law student and that case is still very fresh to me… its really an intriguing case of the determining the meaning of a phrase… good damn thats not hard case to state once you’ve read it once how about the other cases involving provisions from different laws and even after reading for 5 times it still can’t get into your mind what that case is trying to explain… why did i ever enroll in law anyway..Zzz..
